Terms of Use

1. Who this agreement covers

In plain English: This is the agreement between you and TextTrek when you use the site as a teacher, school leader, or parent — students are covered by their school’s authorization instead.

These Terms of Use (“Terms”) are a binding agreement between Ruminate Path LLC d/b/a TextTrek (“TextTrek,” “we,” “us”) and the adult who accesses the Service — a teacher, school administrator, media specialist, parent, or guardian (“you”). By clicking “I agree,” or by continuing to use the Service after being shown these Terms, you accept them. You must be at least 18 years old to accept these Terms.

Student accounts do not accept these Terms. Students access TextTrek under their school’s authorization (including the school’s consent under COPPA’s school-authorization exception), using pseudonymous accounts created by school staff. Nothing in these Terms creates obligations for a student or a student’s family.

These Terms govern your individual use of the Service. They do not modify, and are not intended to conflict with, any separate written agreement between TextTrek and a school district; if such an agreement exists, it controls where the two differ.

2. The Service and your license to use it

In plain English: You get permission to use TextTrek for teaching and learning — and TextTrek is currently free, so we may change features over time.

TextTrek is a reading-practice platform for Florida middle school students, aligned to the B.E.S.T. ELA standards. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for classroom, school, and family educational purposes.

The Service is currently provided free of charge. We may add, change, or discontinue features, and we may modify or discontinue the Service itself, at any time.

3. Your account

In plain English: Keep your login private, and tell us if you think someone else has gotten into your account.

You are responsible for keeping your credentials confidential and for activity that occurs under your account. Do not share your account with others. If you believe your account has been accessed without authorization, notify us promptly at security@texttrek.app, and notify your school’s administration if the account has access to student information.

4. Our content and intellectual property

In plain English: We are protecting the reading passages, questions, and software we created from being copied or stolen.

The Service — including all reading passages, questions, explanations, strategy tips, software, designs, logos, and the selection and arrangement of content — is owned by Ruminate Path LLC and protected by copyright, trademark, and trade-secret law, including registrations with the U.S. Copyright Office. “TextTrek” is a trademark of Ruminate Path LLC.

Except for ordinary classroom use of the Service as designed (for example, projecting a passage to your class or printing a student’s login card), you may not copy, reproduce, distribute, publicly display, sell, license, or create derivative works from the Service’s content without our prior written permission.

5. No scraping or automated access

In plain English: You can’t use bots, scripts, or bulk-download tools to harvest our passages and questions.

You may not access the Service using automated means (including bots, scrapers, crawlers, or scripts), harvest or systematically retrieve content or data from the Service, bulk-export the question bank, or circumvent any technical protection measure (including rate limits, access controls, and session caps). Access in violation of this section is unauthorized access to the Service.

You may not use the Service or its content to train, fine-tune, or evaluate a machine-learning model without our prior written permission.

6. Acceptable use

In plain English: Use TextTrek for its educational purpose — don’t try to break it, resell it, or misuse it.

You agree not to: (a) use the Service in violation of any law or school policy; (b) probe, scan, or test the vulnerability of the Service except as permitted by our responsible-disclosure policy at texttrek.app/security; (c) interfere with the Service’s operation or other users’ access; (d) reverse-engineer or decompile any part of the Service except where that restriction is prohibited by law; (e) resell or offer the Service to third parties; or (f) misrepresent your identity or affiliation.

7. Student data and privacy

In plain English: Students are pseudonymous on TextTrek — we never receive their real names — and we never sell data or show ads.

TextTrek’s pilot architecture is pseudonymous: student accounts are created by school staff with system-generated identifiers, and TextTrek does not receive student names, birthdates, contact information, or demographic data. The school holds the only mapping between pseudonyms and real students.

We do not sell user data, we do not use data for advertising, and we use student activity data solely to provide the Service to the school. See our privacy notice at texttrek.app/privacy for details. If you are school staff, you are responsible for following your district’s policies when handling the pseudonym-to-student mapping outside TextTrek.

8. Feedback

In plain English: If you send us ideas or suggestions, we can use them to improve TextTrek without owing you anything.

If you submit feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free license to use them for any purpose, without obligation to you. Feedback that describes student activity should use pseudonyms only.

9. The Service is provided “as is”

In plain English: TextTrek is a practice tool provided as-is — we can’t promise it will always be available, error-free, or that practice scores will match test results.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT PRACTICE RESULTS PREDICT PERFORMANCE ON ANY ASSESSMENT.

TextTrek is a supplemental practice tool. It is not a substitute for classroom instruction or professional educational evaluation.

10. Limitation of liability

In plain English: This limits what TextTrek can be required to pay if something goes wrong — a standard protection that makes it possible to offer the Service for free.

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) NEITHER TEXTTREK NOR RUMINATE PATH LLC WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, OR GOODWILL; AND (B) OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Suspension and termination

In plain English: We can suspend accounts that break these rules, and you or your school can stop using TextTrek at any time.

We may suspend or terminate access to the Service for violation of these Terms, to protect students or the Service, or upon discontinuation of the Service. You may stop using the Service at any time, and a school may request deletion of its data — we honor deletion requests within 30 days, consistent with our data-retention commitments. Sections 4, 5, 8, 9, 10, and 13 survive termination.

12. Changes to these Terms

In plain English: If we make meaningful changes, you’ll be asked to review and accept the new version before continuing.

We may update these Terms from time to time. When we make material changes, we will present the new version for acceptance at your next sign-in and update the version and effective date shown on this page. Continued use of the Service after acceptance of an updated version is governed by that version.

13. Governing law and general terms

In plain English: Florida law applies, disputes are handled in Marion County courts, and if one part of these Terms fails the rest still stands.

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. The exclusive venue for any dispute arising out of these Terms or the Service is the state or federal courts located in or serving Marion County, Florida, and each party consents to personal jurisdiction there.

If any provision of these Terms is found unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver of it. These Terms are the entire agreement between you and TextTrek regarding the Service, except where a separate written district agreement controls.
